What does selling a house as-is mean?
It means that the seller is listing the home for sale, but is making it clear up front that they will not make any repairs to the home to sell it. Is it legal to / can you sell a house as-is?
Yes. As long as you disclose any issues you know of, it is perfectly legal to sell a home as-is. If you're using the standard TREC one to four family residential contract, section 7D(1) contains a checkbox to state the sale of the home is as-is. As defined by section 7D:
"As Is" means the present condition of the Property with any and all defects and without warranty except for the warranties of title and the warranties in this contract. Buyer’s agreement to accept the Property As Is under Paragraph 7D(1) or (2) does not preclude Buyer from inspecting the Property under Paragraph 7A, from negotiating repairs or treatments in a subsequent amendment, or from terminating this contract during the Option Period, if any.
Remember that stating you're selling a home as-is doesn't mean a buyer cannot perform inspections, etc. if they request - and you agree to - an option period within their offer. Selling as-is means you're stating up front that you won't fix any issues their inspections may find.
How do I decide whether to fix a house or sell it as-is?
Whether or not to make repairs to your home or to sell it as-is is a personal decision. There are pros and cons to each. Making the repairs will likely allow you to sell your home for a higher price, but it also means an outlay of time and cash.
Selling the home as-is on the standard market could take a while to fetch a premium.
